CAMO CAN / ROLL-OUT RENTALS LLC — TERMS OF SERVICE
Effective Date: October 22, 2026 — Version v2026-10-22
These Terms of Service ("ToS") govern use of Company's website, booking system, approval links, and other online services (the "Site"). Roll-Out Rentals LLC d/b/a Camo Can is "Company," and Site users and customers are "Customer." These ToS operate alongside the Dumpster Rental Agreement ("Rental Agreement"), Electronic Consent & Payment Authorization ("Authorization"), Privacy Policy, and Waste Types Addendum presented at booking. Capitalized terms not defined here have the meanings given in the Rental Agreement or the Authorization. Where these ToS conflict with the Rental Agreement, the Rental Agreement controls for bookings; these ToS control use of the Site unrelated to a booking.
SECTION 1 — SERVICES AND ELIGIBILITY
1.1 Nature of Services. Through the Site, Customers may obtain estimates, book Dumpster rentals, approve estimates through single-use approval links, pay charges to a payment method on file, and receive communications about their bookings. All rentals are governed by the Rental Agreement presented for that booking. These ToS bind a Site user on the user's affirmative acceptance — checking an acceptance box, submitting a request through a page that states that submitting it is agreement to these ToS, with a link to them, or completing a booking. Browsing the Site or using the load estimator (including any email or phone verification step it may require) is not, by itself, acceptance.
1.2 Business Hours. Company's route operations and communications are handled during Business Hours (as defined in Sections 1.4 and 1.6 of the Rental Agreement). Requests, notices, and approvals transmitted outside Business Hours are received as provided in Section 3.12 of the Rental Agreement. The Site may accept estimates, bookings, and approvals at any hour, but submission outside Business Hours does not obligate Company to act, respond, or schedule outside Business Hours. Scheduled delivery and pickup dates are not affected by the hour of submission.
1.3 Eligibility. Customer must be at least eighteen (18) years old and legally able to enter binding contracts. Customer represents that all information provided through the Site — including identity, contact information, payment information, Service Address, and waste type selections — is accurate and current.
1.4 Service Area. Bookings are accepted for Service Addresses within the Service Area defined in Section 1.19 of the Rental Agreement, as determined by Company's booking system at booking. Company may, in its discretion, accept bookings outside the Service Area.
SECTION 2 — ESTIMATES AND BOOKINGS
2.1 Estimates. Estimates of charges displayed through the Site (not results of the load estimator, which Section 5.4 governs) are calculated under Section 8 of the Rental Agreement and are good-faith approximations, not final prices. Final charges are determined by the reconciliation described in Section 8 of the Rental Agreement and by any estimates Customer approves.
2.2 Estimate Session. An estimate is tied to the rates, facility pricing, fuel index, and booking-system data in effect when it is generated. If the estimate changes before payment is completed, Customer will be shown the updated estimate and must accept it before booking. Completing a booking fixes the Standard Rates and pre-assigned credits used for that booking's estimate; the final amount is determined under Section 8 of the Rental Agreement.
2.3 Short-Notice Bookings; Booking Confirmation. Company may offer, limit, or disable same-day and next-day bookings at any time. Company also sets, and may change at any time, how far in advance a booking may be made, as shown in the booking system. When offered, a same-day booking must be completed before the same-day cutoff shown in the booking system (currently 11:00 a.m. Central), and short-notice bookings may require Company's review and approval. Company may review a booking before accepting it; a booking is complete only when Company issues the Booking Confirmation following successful payment authorization. The Booking Confirmation states the Customer, the Service Address, selected waste type(s) and Specialty Items, Type Maximum, Rental Period and scheduled dates, Estimated Full-Load Total, Trip Charge and other service charges, the published fuel-price index and the Fuel-Cost Basis (the index price, in dollars per gallon, above which a Fuel Surcharge may apply under Section 8.8 of the Rental Agreement), machinery status, the Service Time Rate, the clearance and space minimums under Section 3.14(a) of the Rental Agreement, and any insurance-certificate requirement, and is archived with the versions of the Rental Agreement, Authorization, ToS, Privacy Policy, and Waste Types Addendum presented at booking.
2.4 Promotions and Promo Codes. Promotional offers and promo codes are subject to the terms stated with the offer, which control over this Section. Unless the offer states otherwise: (a) a promo code is a fixed-dollar discount in the amount stated in the offer, never a percentage. It is shown as a separate line before payment and reduces Company's rental, delivery, and pickup charges for the booking — not disposal, the Trip Charge, taxes, or other charges — and never below zero; (b) only one code may be used per booking; (c) codes have no cash value and cannot be sold, transferred, or combined; (d) each code is issued by Company to a specific person, may be used only by that person, and may be used on only one paid booking; and (e) an offer limited to a first rental applies only if none of the booking's email address, phone number, Service Address, or device matches an existing paying customer. A code is applied when accepted at booking and counted as used when the booking is paid. Company may end or change an offer at any time, but codes already sent remain valid until their stated expiration. A code used by anyone other than the person Company issued it to, or a code Company did not issue or authorize for Customer — including one that was guessed, shared, sold, transferred, or published — is invalid, and no discount is earned by using it. Company may refuse a code, or reverse a discount, that is invalid or that was obtained through false information, multiple email addresses, phone numbers, accounts, devices, or internet connections, a VPN, proxy, or other means of getting around an offer's limits, or other abuse of an offer, and may charge a reversed discount to the Payment Method on File, with an itemized notice stating the reason sent at or before the time of the charge under Section 9.3 of the Rental Agreement. If Customer shows that the code was validly issued to Customer, Company refunds the charge in full. If a booking using a single-use code is cancelled before delivery, the code is restored and may be used once more before its expiration.
SECTION 3 — ACCEPTABLE USE; FRAUD PREVENTION
Customer agrees not to:
(a) misuse the Site or interfere with its operation, including through automated means that impair availability;
(b) misrepresent Customer's identity, ownership or control of the Service Address, or the nature, type, or weight of the material to be loaded;
(c) attempt to access other customers' data, payment information, or booking records;
(d) use the Site to book services for unlawful waste, hazardous materials, or materials prohibited by the Waste Types Addendum;
(e) circumvent approval-link controls, including reusing, sharing, or attempting to reuse a single-use approval link;
(f) scrape, harvest, or bulk-copy Site content or pricing data without Company's written permission; or
(g) place bookings through bots, scrapers, or other automated means, except accessibility software assisting a human user.
Company uses automated fraud-prevention tools, described in the Privacy Policy, and may decline a booking, cancel it under Section 9.6 of the Rental Agreement, or suspend Site access for suspected fraud or misuse.
Approval links. An approval or payment made through a link sent to Customer's email address or mobile number of record is Customer's approval.
SECTION 4 — THIRD PARTIES
4.1 Disposal Facilities. Loads are transported to licensed disposal facilities selected under Section 8.2 of the Rental Agreement. Facility rates, acceptance rules, and permit conditions are set by facilities and regulators, not by Company, and changes in them are handled by the reconciliation in Section 8.3 of the Rental Agreement.
4.2 Payment Processor. Payments are processed through Company's third-party payment processor, as described in Part II of the Authorization.
4.3 Municipal Requirements. Placement in public rights-of-way may require municipal permits, which are Customer's responsibility under Section 3.9 of the Rental Agreement.
4.4 Communications Providers. Text message delivery depends on Customer's wireless carrier, and Company is not responsible for carrier delays, filtering, or non-delivery. Notices are sent as provided in Part I of the Authorization: by email, by text where Customer has opted in, and, where the Rental Agreement says so, by an individual non-automated text under Part I, Section 1.1 of the Authorization.
Text Program. Camo Can service texts: delivery, pickup, billing, and service updates for your booking. Message frequency varies. Message and data rates may apply. Reply HELP for help or contact support@camo-can.com / (918) 935-1054. Reply STOP to opt out, or tell us in any other reasonable way. Carriers are not liable for delayed or undelivered messages. See the Privacy Policy.
4.5 Facility Disclosure of Load Information. Load characterization information may be disclosed to the receiving disposal facility as required or requested by the facility under its permits, acceptance procedures, or applicable law, as described in Section 4.5 of the Rental Agreement and the Privacy Policy.
SECTION 5 — SITE CONTENT; INTELLECTUAL PROPERTY
5.1 Ownership. The Site, its content, branding, pricing methodology, and waste-type schedules are Company property, protected by intellectual property laws. Customer receives a limited, revocable, non-exclusive license to use the Site to obtain Company's services.
5.2 No Reliance on Site Descriptions. Descriptive and educational material on the Site, including waste-type descriptions, blog posts, disposal guides, and the materials listed in the load estimator, is informational. The accepted-materials lists in the Waste Types Addendum and the Prohibited Materials Schedule presented at booking control what may be loaded, under Section 4.1 of the Rental Agreement, and any material the receiving facility cannot lawfully accept is prohibited regardless of Site descriptions.
5.3 Feedback and Uploads. Customer keeps ownership of photos, video, and feedback Customer submits and grants Company a non-exclusive, royalty-free license to use them to provide and document the Services, resolve disputes, and improve the Site. Company will not publish Customer's feedback or name without Customer's permission.
5.4 Load Estimator. The Site's load estimator, and the weights, volumes, and conversion figures it uses or shows, are a planning aid under Section 6.1. Its figures are typical figures from published third-party sources, such as government agencies, manufacturers, industry associations, and waste-industry sources, which Company does not independently verify. Actual weights and volumes vary with moisture, compaction, product, age, and other factors. Estimator results are not a quote, are not an estimate of charges under Section 2.1 or Section 8 of the Rental Agreement, are not part of the Booking Confirmation, and are not a representation that a load will fit within any Type Maximum or other weight or volume limit. A material's appearance in the estimator does not mean it is accepted; Section 5.2 and the Waste Types Addendum control what may be loaded. This Section does not apply to the Type Maximum, prices, the Trip Charge, Specialty Item caps, or other terms displayed in the booking system or stated in the Booking Confirmation, which are terms of Customer's booking.
Customer is responsible for keeping Customer's load within the Type Maximum and the other limits of Customer's booking, whether or not Customer used the estimator. Company's own assessment of a load at pickup under Section 8.2 of the Rental Agreement does not shift that responsibility. If Customer enters an estimated weight or volume at booking, including one taken from the estimator, it is Customer's good-faith estimate, is used only as Section 8.1(a) of the Rental Agreement provides, and is not a misrepresentation under Section 1.3 or Section 3(b) merely because the load turns out to be heavier or larger. The final amount for a booking is determined under Section 8 of the Rental Agreement; the disposal charge is settled against the disposal facility's scale ticket or receipt for the load, not against estimator results.
To the maximum extent permitted by law, Company is not liable for any difference between estimator results and the actual weight or volume of a load. Any charge, refusal, or Trip Charge that applies under the Rental Agreement because a load exceeds the Type Maximum or other limits of the booking applies whether or not Customer relied on the estimator. For a booking, this Section does not change how the Rental Agreement allocates charges, credits, or liability (including Sections 4.3, 8, and 10 of the Rental Agreement); for Site use unrelated to a booking, Section 6.2 applies. Nothing in this Section limits liability that cannot be limited under Oklahoma law, including liability for fraud, gross negligence, willful misconduct, or violation of law to the extent 15 O.S. § 212 prohibits limiting it.
SECTION 6 — WARRANTY DISCLAIMER; SITE AVAILABILITY
6.1 As-Is Site. The Site is provided "as is" and "as available." To the maximum extent permitted by law, Company disclaims warranties regarding uninterrupted or error-free Site operation and does not warrant that estimates, booking, or approval links will always be available or error-free. Company disclaims all implied warranties for the Site, including merchantability, fitness for a particular purpose, and accuracy of Site content, the load estimator, and disposal guides, which are planning aids only.
6.2 Limitation. Liability arising from a Dumpster rental is governed by Section 10 of the Rental Agreement. For Site use unrelated to a booking, and to the maximum extent permitted by law, Company's total liability is limited to the greater of one hundred dollars ($100) or the amounts Customer paid to Company in the twelve (12) months preceding the claim. Nothing in this Section limits liability that cannot be limited under Oklahoma law, including the matters listed in Section 10.2 of the Rental Agreement.
SECTION 7 — CHANGES TO THESE TERMS
Company may revise these ToS, posting the revised version with its effective date; for a material change, Company also notifies customers with active bookings by email. The ToS presented at booking control each booking, and the version governing an existing booking does not change. A change to the dispute provisions does not apply to a dispute of which either party gave notice before the change was posted. A revised version applies to a user's future bookings and Site use once the user accepts it under Section 1.1.
SECTION 8 — TERMINATION; SURVIVAL
8.1 Termination. Company may suspend or terminate Site access for breach of these ToS, the Rental Agreement, or applicable law, or to protect the Site or other customers. Customer may stop using the Site at any time; stopping Site use does not cancel a booking, which must be cancelled as provided in the Rental Agreement (including Sections 3.4(d), 3.13, and 9.1). A suspension or termination of Site access does not block the approval links, choices, and notices for an active booking; Company continues to provide them, or accepts the written and telephone alternatives the Rental Agreement allows, until the booking is settled.
8.2 Survival. Booking obligations, payment obligations, Sections 2.4, 5.2, 5.3, 5.4, 6, 9, and 10 of these ToS, and provisions of the Rental Agreement and Authorization survive termination of Site access and completion of bookings.
SECTION 9 — DISPUTES; GOVERNING LAW
These ToS are governed by Oklahoma law. Any dispute arising out of or relating to a booking, the Site, these ToS, the Privacy Policy, or Company's communications with Customer (including text messages and emails) is resolved under Sections S.3 and S.4 of the Rental Agreement, which apply to that dispute as if it arose under the Rental Agreement: individual claims within small-claims jurisdiction must be brought in small claims court, other claims are resolved by individual arbitration with a class-action waiver, and Customer may opt out of arbitration within thirty (30) days after first accepting a version containing that provision. Nothing in these ToS limits consumer rights that cannot be waived under applicable law.
SECTION 10 — ENTIRE AGREEMENT; CONTACT
These ToS, together with the Rental Agreement, the Authorization, the Waste Types Addendum and Schedule A-1 presented at booking, the Booking Confirmation, each approval-link estimate Customer approves, and the terms of any promotional offer applied to a booking, constitute the entire agreement regarding the Site and Customer's bookings, subject to the order of precedence in Section S.2 of the Rental Agreement. If any provision of these ToS is held unenforceable, the remaining provisions continue in full force, and that provision is reformed to the minimum extent necessary to make it enforceable.
